Please read these terms carefully before using the WhatYouThink platform. By accessing the Platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using WhatYouThink ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and WhatYouThink.

2. Description of Service

WhatYouThink is an AI-powered prediction market platform that enables users to trade event contracts on sports outcomes and other events. The Platform is currently in beta and access is provided on an invitation-only basis through our waitlist program. Features, pricing, and availability may change at any time.

3. Eligibility

You must be at least 18 years of age to use the Platform. By using WhatYouThink, you represent and warrant that you are 18 years or older, have the legal capacity to enter into these Terms, and are not prohibited from using the Platform under applicable laws in your jurisdiction. Prediction market trading may be restricted or prohibited in certain jurisdictions. You are solely responsible for determining whether use of the Platform is legal in your location.

4. User Accounts

When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. WhatYouThink reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.

5. Trading and Financial Risk

Trading on prediction markets involves substantial financial risk. You may lose some or all of the funds you invest. Past performance is not indicative of future results. AI-generated market prices and predictions are probabilistic estimates and should not be construed as financial advice. You acknowledge that you are trading at your own risk and that WhatYouThink is not responsible for any trading losses. You should only trade with funds you can afford to lose.

6. Prohibited Conduct

You agree not to: (a) use the Platform for any illegal purpose or in violation of any applicable laws; (b) manipulate market prices or engage in wash trading, spoofing, or other forms of market manipulation; (c) use automated bots or scripts to access the Platform without our prior written consent; (d) attempt to reverse engineer or circumvent any security measures; (e) create multiple accounts to exploit promotions or bonuses; (f) share, sell, or transfer your account to any third party; (g) use the Platform while located in a jurisdiction where prediction market trading is prohibited.

7. Intellectual Property

All content on the Platform, including but not limited to AI-generated markets, data, software, design elements, text, graphics, and logos, is the property of WhatYouThink or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only. You may not reproduce, distribute, or create derivative works from any Platform content without our express written permission.

8. AI-Generated Content

The Platform uses artificial intelligence to create prediction markets, generate odds, and provide analytical insights. AI-generated content is provided for informational purposes only and does not constitute financial, legal, or professional advice. WhatYouThink does not guarantee the accuracy, completeness, or timeliness of AI-generated content. You acknowledge that AI systems can produce errors and that you should not rely solely on AI-generated information when making trading decisions.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your personal information as described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WHATYOUTHINK DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHATYOUTHINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO WHATYOUTHINK IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless WhatYouThink and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

WhatYouThink reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in class action lawsuits against WhatYouThink.

14. Changes to Terms

WhatYouThink reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
